NEPA Requirements Associated with Department of Commerce CHIPs Program Office Funding

June 12, 2024 - The National Environmental Policy Act (NEPA) (42 U.S.C. 4321 et seq.) requires federal agencies to consider the effects of proposed actions on the human environment. The Council on Environmental Quality (CEQ) has issued regulations to implement NEPA (40 CFR Parts 1500–1508) that apply to all federal agencies. Funding decisions being completed for semiconductor manufacturing and support facilities resulting from the CHIPs and Science Act represent federal actions for which NEPA is applicable. The CHIPS Program Office (CPO), on behalf of the National Institute of Standards and Technology, is responsible for any required environmental review under the NEPA. While CPO is responsible for the accuracy, scope, and content of any required NEPA documents, applicants are required to participate in the environmental review process and are often tasked with the primary development of NEPA documents. The webinar will provide an overview of the NEPA implementation process and the evolving processes being utilized by CPO for NEPA review and practical considerations for NEPA project planning for CHIPS funding applicants.
