Toxic Substances Control Act (TSCA): Chemical Screening Crucial to Compliance

The Toxic Substances Control Act (TSCA) regulates any entity that manages chemicals including their manufacture, import, export, processing, distribution, and use. The Semiconductor industry is a key part of the regulated community and TSCA non-compliance can result in significant impacts to business operations. The most recent example being the Significant New Use Rule (SNUR) governing perfluoroalkyl sulfonates (PFAS), finalized in December of 2002, which threatened the development of new technologies in the Semiconductor industry. This SNUR has served to heighten TSCA awareness within the Semiconductor industry and encourage the re-evaluation of TSCA compliance systems. The most critical of these systems involves the assessment of chemicals prior to use and, more importantly, importation. Without an effective screening process to determine regulatory obligations, an organization cannot expect to maintain compliance with TSCA regulations. This presentation gives an overview of a comprehensive TSCA chemical screening program highlighting the most common obstacles, such as the unqualified reliance on Material Safety Data Sheet information, and how to properly overcome them.
